Wright Wilmarth Byrd law firm celebrated Christmas a bit early by adjourning one November afternoon to Brush with Art, where we painted and partied. We are pretty happy with our admittedly amateur efforts!

Texas businesses often forget that they have to follow the laws of another state when they have operations, clients, and particularly employees located outside of Texas. And many of those states impose much greater legal obligations on employers than Texas does. Vicki Wilmarth reminds businesses that they need to rely on employment law counsel for help complying with all the variations of paid leave, minimum wage, worker's compensation, etc. in other states.

As a Texas employer, your employees in other states are protected by the laws of the state in which they perform their work, not Texas law.

Vicki Wilmarth's latest employer alert explains the injunction entered against the salary minimum rule that was to take effect on January 1, 2025.

On Friday, November 15, a federal judge in the Eastern District of Texas ordered a nationwide halt to the rule increasing the minimum salary that was set to go into effect on January 1, 2025, so that employers no longer have to raise the salary level of employees who are exempt from overtime to $58,...

Employment lawyers were expecting this. The increase in the minimum pay that employers must pay to salaried workers has been thrown out by a federal district judge in Texas (not the Amarillo judge, surprisingly). We are back to pre-July 2024 numbers. Salaried workers only have to make $35,568 annually to be considered exempt from overtime. Of course, to be paid on salary, that worker also has to perform certain white-collar job duties (the harder part of the test to meet). Otherwise, all workers should be paid hourly and receive overtime if they work more than 40 hours in one workweek.

On November 15, 2024, the U.S. District Court for the Eastern District of Texas vacated and set aside the U.S. Department of Labor (DOL)’s final regulation increasing the salary threshold for the “white collar” overtime exemption under the Fair Labor Standards Act (FLSA) on a nationwide basis....
