USCIS has released a new policy memorandum stating that noncitizens who are otherwise eligible for adjustment of status will only be granted adjustment in “extraordinary circumstances.” Under the memorandum, applicants may instead be required to depart the United States and apply for an immigrant visa through consular processing abroad.

Because this memorandum was just issued and clearly conflicts with longstanding statutory adjustment provisions enacted by Congress, the scope and enforceability of the policy remain unclear. We are closely monitoring further guidance and interpretation before advising clients on how this policy may affect pending or future cases. We will also be monitoring for potential class action lawsuits challenging the policy and may participate in appropriate litigation on behalf of affected clients.
