Notice: Transition to English in the Judiciary

​We would like to inform all our clients that the recent Judicial Circular No. 1/2026, which mandates English as the official working language of the courts, will not affect our operations in any way.

On 13th May 2026 the Chief Justice of the Judiciary of the Republic of South Sudan issued a Judicial Circular Directing all Judges to use English Language to write Judgements. Bellow is the summary of the circular;

Summary of the Judicial Circular No 1/2026 - use of English Language as an official Language of the courts.

​The circular establishes and affirmed English as the sole official working language of the courts in the Republic of South Sudan, bringing judicial practice into alignment with Article 6(2) of the Transitional Constitution.

It notes that previous laws, such as the Civil Procedure Act of 2007, which allowed for both English and Arabic, are now superseded by the Constitution and the principle that a later law repeals an earlier one ("Posterior Derogat Priori").

​Key Directives

​Mandatory English Judgments: Starting June 1, 2026, all judges are required to write their judgments in English.

​Training and Support: The Judiciary, in collaboration with the University of Juba and other institutions, will provide resources and training to help judges meet this requirement.

Judges are also encouraged to improve their handwriting and language skills independently.

​Compliance Review: The Judiciary will review progress in January 2027, at which point "appropriate action" may be taken against those still unable to write judgments in English.

​Regional Alignment: This shift is also intended to harmonize South Sudanese laws with the Treaty of the East African Community.

We extend our Congradulations to the newly appointed Chief Justice and Deputy Chief Justice.

There are dare need for reforms within the Judiciary and we believe that the new appointees will live up to our expectations:

Some of the desired reforms includes;

1. Reconstitution of the pannel of the supreme court to meet the required legal qourum.

2. Review of the Remunerations and benefits of Judges and Justices and court clarks

2. Recruitment and redeployment of Majestrates and Judges to counties and states that are lacking formal Justice mechanisms.
