In legal terms, the "burden of proof" refers to the responsibility or obligation of a party to prove the truth of their claim or assertion in a legal case. It is the obligation to prove the validity of the facts or arguments presented in court.

The burden of proof usually rests on the party who makes a claim or allegation, and that party must present sufficient evidence to prove the claim. For example, in a criminal case, the prosecution has the burden of proving that the defendant is guilty of the crime charged.

In a civil case, the plaintiff has the burden of proving that the defendant is responsible for the harm they suffered.

The Kuala Lumpur High Court on 3rd March 2023 ruled that the prosecution failed to establish a prima face case against DS Najib Razak.

Najib was charged with using his position as then-prime minister to order amendments to 1MDB's final audit report before it was presented to the Public Accounts Committee (PAC) in 2016 to prevent any action against him.

Do you know what “prima facie” means?

“Prima facie" is a Latin term used in legal contexts that means "at first sight" or "on the face of it." It refers to evidence that is strong enough to establish a fact or prove a case if it is not contradicted or rebutted. In simpler terms, prima face evidence is evidence that, if taken at face value, appears to be sufficient to support a conclusion until proven otherwise.

"See you in Court!" "Aku saman kau nanti!" Selalu tak dengar ayat-ayat ni digunakan?

Boleh ke sesuka hati nak saman orang di Mahkamah? Tak puas hati je nak saman menyaman.

Sebenarnya, kita tidak boleh sesuka hati menyaman orang. Sekiranya alasan saman kita tidak mempunyai asas yang sah, pihak yang disaman boleh memohon kepada Mahkamah untuk membatalkan saman kita atas alasan bahawa saman kita "obviously unsustainable".

Permohonan pembatalan saman ini dibuat dibawah A.18, k. 19(1) Kaedah-Kaedah Mahkamah 2012. Mahkamah di dalam Bandar Builder Sdn Bhd & Ors v. United Malayan Banking Corporation bhd [1993] 3 MLJ 36 menyatakan bahawa permohonan pembatalan saman boleh berjaya sekiranya kes saman tersebut "obviously unsustainable".

Jadi sebelum nak saman tu, pastikan yang kita sebenarnya ada satu kes yang kukuh dan bukannya bertindak mengikut emosi kita ya!
