Can a person sue for libel simply because a court order was served on a bank?

The Malaysian Court of Appeal has answered no.

The Court held that serving valid court orders on banks or other third parties in the course of enforcement is not, by itself, actionable in libel. The decision reinforces the importance of allowing court orders to be enforced without fear of defamation claims.

This is an important development for litigants and practitioners involved in judgment enforcement, injunctions and banking-related litigation.
