As part of our pupils’ legal journey ⚖️, the firm has organized a series of in-house sessions to equip our pupils with practical insights and a deeper understanding of key areas of our practice.

We are pleased to kick off the series with Michelle , our Legal Associate, who will be leading the first session on Extension of Time (EOT), Liquidated Ascertained Damages (LAD), and Loss & Expense,core concepts frequently encountered in construction disputes 🚧.

While the programme is tailored for our pupils, the session is open to everyone in the firm, ostering a shared learning experience across all levels 🫱🏽‍🫲🏼

Another important question before the Federal Court in Lim Swee Choo to address the controversy in the decision of the earlier case of Damansara Realty Berhad v Bungsar Hill Holdings Sdn Bhd🤨

In Damansara Realty, the Court suggested that even if part of the promise had been performed, there could still be a total failure of consideration if, viewed objectively, the performance had little or no commercial value.

But in Lim Swee Choo, the Federal Court clarified that both Damansara Realty (in obiter) and Berjaya Times Square are no longer good law. The correct test now is the one from Stocznia Gdanska: whether the promisor has performed any part of his obligation for which payment is due 💲

In this video, we look at the facts of Damansara Realty, how the Federal Court addressed the case in Lim Swee Choo, and ultimately settled the real test for total failure of consideration.
