Gig Worker or Independent Contractor – Is There a Difference?

The Gig Workers Act 2025 (“GWA”) came fully into force on 31 March 2026. It introduces a legal framework to protect individuals in the gig economy. However, not all independent contractors are gig workers.

Why it matters? Misclassification may expose businesses to penalties of up to RM50,000 and/or 2 years’ imprisonment.

Businesses engaging service providers should promptly review their arrangements to ensure compliance with the GWA.

Did you know that a director can be held personally liable for unpaid EPF contributions? ⚖️

The Federal Court recently confirmed that section 46 of the EPF Act 1991 makes directors, partners, and office bearers jointly and severally liable, and EPF can go after directors directly without including the Company entity in a legal suit.
