In TJS v BP Diagnostic Centre Sdn Bhd, the Industrial Court examined whether a healthcare professional engaged under a partnership-style arrangement could claim unfair dismissal.

The Court looked beyond the contract label and assessed the operational reality of the relationship, including remuneration structure, level of control, and the right of substitution.

Ultimately, the Court found that the claimant was a self-employed professional, not a “workman”, meaning the Industrial Court had no jurisdiction over the claim.
