📢 8% SST on Commercial Rental Services – Effective 1 July 2025
Under PU(A) 172/2025 – Service Tax (Amendment) Regulations 2025, the Malaysian government is implementing 8% Service Tax (SST) on commercial rental services, effective 1 July 2025, with specific rules for registration and compliance.

🏢 Who Is Affected?
- Landlords of commercial properties
- Those with annual rental income exceeding RM500,000

📈 Trigger Threshold: RM500,000 per year
Once a landlord's taxable rental income reaches RM500,000, SST obligations kick in.
📌 Example Timeline
- If the RM500k threshold is reached in July 2025:
🔸 Must register for SST by 1 August 2025
🔸 Must begin charging 8% SST from 1 September 2025

📝 12-Month Rule – Limited Scope
- Applies only to non-reviewable tenancy agreements
- Does not apply to agreements executed before 1 July 2025
- Rent-outs prior to July are excluded from the new SST scope

🕒 Pending Clarification
We’ve contacted SST Department, M*F for guidance on other potential grace periods and transitional treatment. A follow-up update is expected once internal verification is complete.

The Inland Revenue Board of Malaysia's (LHDN) recent clarification regarding stamp duty on employment contracts:

- Contracts signed before 1 January 2025: Exempt from stamp duty and late stamping penalties.
- Contracts signed between 1 January 2025 and 31 December 2025: Subject to stamp duty, but late stamping penalties are waived if stamped before 31 December 2025.
- Contracts signed from 1 January 2026 onwards: Late stamping will incur penalties.

We recommend reviewing your employment contracts to ensure compliance with the Stamp Duty Act 1949 to avoid future penalties. The official LHDN circular is attached for your reference.
