What is a Decree of Divorce, and why does it matter?

A divorce is not final simply because you and your spouse have agreed to separate or completed the application paperwork.

The marriage legally ends when the judge grants the divorce and the court finalises the divorce order.

Your Decree of Divorce confirms that the marriage has been dissolved. Once the divorce has been granted, both former spouses are legally free to remarry.

Simple Divorce guides eligible clients through the process from the initial application and document preparation through to the Decree of Divorce.

Our service is designed for straightforward cases where both spouses are broadly in agreement.

Can you apply for divorce if you and your spouse still live at the same address?

In Ireland, living apart does not always mean living in separate homes.

You may be considered to be living apart while sharing the same property, provided you are no longer living together in an intimate and committed relationship.

To apply for divorce, you must have lived apart for at least two of the previous three years. You must also meet the other legal requirements, including the residency requirement and having no reasonable prospect of reconciliation.

Every situation is different. Simple Divorce can assess your circumstances and explain whether its fixed-fee service is suitable for you.

Can you get divorced in Ireland without a long, expensive court battle?

If both spouses are in agreement on the main terms, such as finances, property and arrangements for children, you may be able to apply for an uncontested divorce.

An uncontested divorce still has to go through the court system, but the process is far more straightforward when there is nothing left for a judge to decide.

Our latest guide explains:

• What uncontested divorce means in Ireland
• How it differs from a contested divorce
• The legal requirements you need to meet
• How mediation can help couples reach agreement
• What happens at each stage of the process
• How long it takes and what it costs
• Common mistakes that can cause delays

Once a divorce is finalised, updating your will is one of the first things worth doing.

In Ireland, a Decree of Divorce automatically revokes any gift left to a former spouse in an existing will – but it doesn't create a new one.

If you don't update your will, you could be leaving things legally unclear at a difficult time for your family.

It's a straightforward step that's easy to put off.

Better to deal with it while things are fresh.

What if your spouse isn't engaging with the process?

It's more common than people think.

One person is ready to move forward, the other is slow to respond or reluctant to engage.

In an uncontested divorce, you do need a level of cooperation from both sides – but it doesn't have to be perfect.

If communication is difficult, keeping things in writing helps.

And if you're unsure whether your situation can still proceed, talk to us.

Sometimes things are further along than they feel.
