⏳ Three years. That's the deadline most people don't think about until it's too late.

Most personal injury claims in England & Wales have a three-year limitation period from the date of the accident. Miss it and the claim is usually gone, however strong it was.

But it isn't always that simple. For children, the clock doesn't start until their 18th birthday. In illness and clinical negligence cases it can run from your date of knowledge - when you first realised the injury was serious and linked to someone else's actions.

Criminal injuries claims have their own two-year window, and many housing disrepair claims run to six years.

Not every injury is a "serious injury" in legal terms — and knowing the difference matters.

A serious injury is one that causes long-term physical, psychological and financial impact. Usually it means ongoing treatment, rehabilitation or specialist care for years, not weeks.

🏠 Case in Point — a leaking roof that was never fixed.

Our client reported the leak to their landlord. Nothing was done. The problem was left to worsen - and asbestos was exposed into the property.

📂 Case in Point — one swerve to avoid an animal, another to avoid a curb, and a passenger paid the price.

Our client was being driven by his brother when an animal ran out into the road. The driver swerved to avoid it — then swerved again to avoid the curb — but lost control of the back of the vehicle. The car hit the central reservation, spun, and struck a wall side-on.

Our client, a passenger with no control over what happened, suffered a compound fracture to his humerus and spent almost a week in hospital. He's left with a permanent scar and can no longer fully straighten his left arm.
