Most personal injury claims in England & Wales have a three-year limitation period from the date of the accident. Miss it and the claim is usually gone, however strong it was.

But it isn't always that simple. For children, the clock doesn't start until their 18th birthday. In illness and clinical negligence cases it can run from your date of knowledge - when you first realised the injury was serious and linked to someone else's actions.

Not every injury is a "serious injury" in legal terms β€” and knowing the difference matters.

Our client was being driven by his brother when an animal ran out into the road. The driver swerved to avoid it β€” then swerved again to avoid the curb β€” but lost control of the back of the vehicle. The car hit the central reservation, spun, and struck a wall side-on.
