Early conciliation: adding new respondents - what happened
The case highlights the importance of careful handling of early conciliation. The key points:
- while it’s helpful to identify respondents early, the EAT allowed the claim to be amended to include all of the subsidiaries later
- once a claim is accepted, the early conciliation provisions cease to apply and standard case management takes over
- the aim is to resolve disputes without unnecessary formality or expense
Claimants should aim to identify as many potential respondents as possible at the outset, to help avoid the time and expense involved in dealing with technical points later.
