In an environment where complex and technically demanding cases are increasingly becoming the norm, it is more important than ever to closely review the matters that have not progressed.

At Barton Law, we can efficiently process straightforward cases; that is not the difficult part of the conveyancing work in a lifetime mortgage. Where we differentiate ourselves is in the technical cases that require expertise, experience, and a proven track record of resolving issues others haven’t been able to. We often inherit cases from other firms that have been unable to find a viable solution, and our specialist team brings decades of expertise that cannot be replicated overnight.

We offer pre‑application guidance on how lenders are likely to approach more complex circumstances. While these cases naturally take longer than a routine instruction, they can and do complete with the right strategy and client expectations set from the outset.

Some of the notable cases we have successfully taken through to completion this year include:
āœ… A property with an overage agreement on
āœ… A Matrimonial case with a defective Financial Consent Order
āœ… A property subject to re-possession
āœ… The division of a freehold house into leasehold flats and an adverse possession claim for part of the roof
āœ… The purchase of a new build property while liaising with green third party solicitors who exchanged contracts 6 months earlier and were refusing to recognise enact.

In the current landscape, a single solution or standard approach is no longer enough. The largest part of our work is now at pre‑application stage, discussing the case with advisers and working through scenarios with enact to achieve the best outcome for clients.

We very rarely advise that a case cannot proceed due to legal issues. Our longstanding relationship with enact built over several decades of mutual respect allows flexibility where possible. Don’t walk away from a case simply because it appears tricky as while it may be complex, with us on your side the odds are in the client’s favour.
