In New South Wales, the statutory duty of care owed by builders and developers cannot be delegated.

On a modular project, that means the party answering to the owner stays the same even when design, manufacture and transport are carried out by others, sometimes overseas. When a module arrives with a defect, the real question is whether that party can recover from the one that caused it.

Planning decisions led the week: a battery and two data centres won consent, a modern methods of construction program named its shortlist, and an Eastern Suburbs housing exhibition was extended.

Planning reform was measured in speed and numbers this week. Councils that met the state's assessment benchmark are sharing in a new round of infrastructure funding, council planners are getting state-funded training on the new rules, and more housing projects have joined the State Significant pathway.

Grid and transport works moved ahead on the ground too. Crews have started stringing conductors in the Central-West Orana REZ, HumeLink has taken delivery of its first large shunt reactors, and Australian-made switchboards are being supplied for the Western Sydney Airport metro line.

Data centres led the conversation in NSW this week, with a major facility approved at Glendenning in Western Sydney, early plans lodged for a large campus outside Wagga Wagga, and a community package on the table for AirTrunk's proposed site at Kurri Kurri.

Western Sydney kept building momentum too. Contracts are now signed on a new set of road upgrades, the Southwest Metro stations are finished and ready for service, and Freecity's modular student tower at Macquarie Park has passed the halfway mark.

NSW's ten-year defect insurance regime has its first approved policy, and the Government has tied thousands of new homes to a new eastern suburbs station, the Parramatta Metro contract and surplus WestConnex land.

Further along the pipeline, a major Macquarie Park data centre won approval, three storage projects cleared grid milestones, and a national program will fast track qualifications for experienced construction workers as prefabAUS sets out its procurement agenda.

On a construction project, claims move up the chain and money moves back down it: subcontractor to head contractor, head contractor to principal.

The Security of Payment Act governs the recoverability of every dollar in that chain. Subcontractors claim under it, principals respond under it, and head contractors do both at once.

The process of claiming and responding can be unforgiving. A payment claim that misses its mark recovers less than the work was worth. A payment schedule that misses its mark can leave the respondent liable for the full amount claimed, regardless of the merits.

The SOPA Tabletop is about closing both gaps: claims that hold up to their full value, and schedules that hold up to their full protection. Subcontractors will see how their claims are tested and head contractors will see how their responses are read.

One statewide Community Participation Plan has taken effect in NSW, replacing more than 100 council and agency plans, though guidance on how councils engage their communities is still a month away.

The week's other terms were set on the grid and on site: data centres asked to bond and pay for their connections, a wind farm cleared to add storage inside an existing approval, and a trades forecast that widens as the same electricians are pulled in several directions.

The Sydney Plan has been finalised, though the targets it sets run to 2046. Housing and employment numbers are now apportioned to each council area, and every council carries an ongoing feasible capacity test in its Local Environmental Plan.

The rest of the week sat at different removes from delivery: consents for a hospital and an airport upgrade came with builders engaged early and main works still years off, high speed rail systems bidders were invited into a development phase, and a proposed trust tax on builders remains consulted on but unlegislated.
