Received a Visa Refusal? Know What to Do Next.

A visa refusal can be stressful, particularly when you are unsure whether you can appeal the decision or what your options are.

The first step is to carefully read your refusal notification letter. It should explain the reasons for the refusal and, where applicable, whether you have a right to seek review at the Administrative Review Tribunal (ART) and the relevant time limit.

Depending on your circumstances and the type of decision, your options may include:
🔹 ART review of a reviewable decision
🔹 A new visa application, where appropriate
🔹 Judicial review where there may be a legal error
🔹 Exploring another available visa pathway

⏰ Don't wait to check your options. Review time limits can be strict, and the Tribunal may have limited or no power to extend the applicable deadline.

✈️ Permanent Resident? Check your travel rights before you fly.

Being an Australian permanent resident does not automatically mean you can return to Australia after travelling overseas. Your permanent visa has a travel facility, which determines whether you can leave and re-enter Australia as a permanent resident.

Before travelling, Home Affairs recommends that permanent residents:
🔹 Check their travel facility expiry date in VEVO
🔹 Make sure the travel facility remains valid for the planned trip
🔹 Check that their passport is valid and linked to their visa
🔹 Consider applying for a Resident Return Visa (RRV) if the travel facility will expire before they return.

If your travel facility expires while you are overseas, you generally need to be granted an RRV before returning to Australia as a permanent resident. Home Affairs also warns against attempting to return on a Visitor visa or ETA instead of an RRV, as this can have serious consequences.

Thinking about Victorian skilled visa nomination? Here’s how the Victorian Points Test (VPT) works.

Victoria uses the Victorian Points Test (VPT) to rank Registrations of Interest (ROIs) for the Skilled Nominated visa (subclass 190) and Skilled Work Regional (Provisional) visa (subclass 491).

The VPT considers seven factors:
✅ Age
✅ English language
✅ Skilled experience
✅ Educational qualification
✅ Occupation skill level
✅ Partner’s skills, where applicable
✅ Annual skilled employment earnings in Victoria, where applicable

What you should know:
🔹 There is no fixed VPT pass mark.
🔹 ROIs are ranked against other candidates in the pool.
🔹 Victoria may invite candidates through Most Competitive and Priority Industry pathways.
🔹 You must also meet the Australian Government's visa and SkillSelect requirements.
🔹 An invitation or nomination is not guaranteed.

We are pleased to celebrate the recent grant of a Protection (Subclass 866) visa for our client.

Protection matters can involve complex legal requirements, sensitive personal circumstances, credibility issues, and detailed supporting evidence. Where a decision has already been refused, the review process may also require careful preparation of the applicant's case and evidence.
