Australian citizenship approved despite serious character and visa cancellation concerns.
Emigrate Lawyers recently assisted a New Zealand citizen whose Subclass 444 Special Category Visa had been cancelled, resulting in the client being denied entry to Australia.
The matter also involved previous police and court history, Departmental character concerns, and a prior Form 1111 Notice of Intention to Consider Cancellation.
Our team prepared detailed legal submissions addressing the client’s circumstances, the background to the concerns, the client’s remorse and reflection, and why the client should still be considered a person of good character.
The result: Australian citizenship by descent approved.
This was a significant outcome and a reminder that complex immigration history does not always mean the end of the road. With careful preparation, strong evidence, and properly drafted legal submissions, a person’s circumstances can be presented fairly and in context.
If you are dealing with citizenship character concerns, visa cancellation, Subclass 444 issues, or a Department notice, seek legal advice before responding.
