Going out on my own in 2020 has been one of the most rewarding leaps of faith of my life. It’s equal parts challenging and exciting. It’s a journey ventured and possible with the support and encouragement of great colleagues in the profession and a steadfast squad of family and friends. I'm tremendously grateful for each and every one of them.

⚠ From today, anyone who holds a current role, or who is planning on becoming a Director, must be aware of their 𝗼𝗯𝗹𝗶𝗴𝗮𝘁𝗶𝗼𝗻 to obtain a Director Identification Number (DIN). Holding a DIN is 𝗺𝗮𝗻𝗱𝗮𝘁𝗼𝗿𝘆, but there are some interim grace periods to apply for one.

Did you know that if a person or entity can show uninterrupted, exclusive use of someone else's property 🏡 over a period of 12 years, they can make a claim for legal title 📜 to that property ❗❓

In a recent Supreme Court ⚖ case involving land adjoining the 𝗠𝗼𝘂𝗻𝘁 𝗚𝗶𝗹𝗲𝗮𝗱 𝗘𝘀𝘁𝗮𝘁𝗲 in 𝗖𝗮𝗺𝗽𝗯𝗲𝗹𝗹𝘁𝗼𝘄𝗻, that's exactly what the developer tried to do....unsuccessfully.

Developer 🆚 Land Owner: 0 : 1

It's an interesting legal principle and case to read. I've provided a snapshot in this article, published today:

Adverse possession occurs when a person or entity acquires the title to a property from the original owner, without paying for it, because they can prove uninterrupted possession of the property, to the exclusion of the owner and third parties.

'𝘼𝙣𝙮 𝙥𝙪𝙗𝙡𝙞𝙘𝙞𝙩𝙮 𝙞𝙨 𝙜𝙤𝙤𝙙 𝙥𝙪𝙗𝙡𝙞𝙘𝙞𝙩𝙮'? 🤔 Surely that's not what is being said over at 𝗟𝗼𝗿𝗻𝗮 𝗝𝗮𝗻𝗲 this month. ❌

If you're looking for a 📚 textbook example of , and conduct, here it is.

Despite the company conducting no testing, it claimed in its advertising of a product in July 2020, amongst other things:

🔹 "LJ SHIELD is a ground-breaking technology that makes transferal of all pathogens to your Activewear... impossible by eliminating the virus on contact with the fabric."

🔹 "With Lorna Jane Shield on our garments it meant that we were completely eliminating the possibility of spreading any deadly viruses"

🔹 "Cure for the Spread of COVID-19? Lorna Jane Thinks So."

The Federal Court Judge deemed the conduct "𝙚𝙭𝙥𝙡𝙤𝙞𝙩𝙖𝙩𝙞𝙫𝙚, 𝙥𝙧𝙚𝙙𝙖𝙩𝙤𝙧𝙮 𝙖𝙣𝙙 𝙥𝙤𝙩𝙚𝙣𝙩𝙞𝙖𝙡𝙡𝙮 𝙙𝙖𝙣𝙜𝙚𝙧𝙤𝙪𝙨". In addition to being ordered to pay $5million in , Lorna Jane was ordered to publish corrective notices across the mediums utilised in the marketing campaign, establish a consumer law compliance program, and pay the ACCC’s costs.

Lorna Jane has been slapped with a $5 million fine over claims its activewear would "stop the spread" of coronavirus.

Insurers lose ⚖ challenge over business insurance COVID payouts. 💰💰

Many Australian businesses had insurance when the pandemic hit to cover them for losses caused by 𝗶𝗻𝘁𝗲𝗿𝗿𝘂𝗽𝘁𝗶𝗼𝗻 𝘁𝗼 𝘁𝗿𝗮𝗱𝗲. However, the insurance industry claims these policies were not designed to cover a pandemic.

In a Judgment delivered in late June, the High Court rejected the insurers' argument.

The insurers have geared up for 𝗥𝗼𝘂𝗻𝗱 𝟮 though, lodging another test case which seeks to clarify, among many issues, whether businesses actually needed a confirmed case of COVID-19 within close proximity to their business to be paid out for losses related to the pandemic. Stay tuned...

The High Court move has spurred law firms to launch class actions to resolve the drawn-out saga.
