Rental Deposits: Can a Tenant Request a Fixed Interest Rate?

In this episode of The Property Law Alliance, Bruno Miguel Simao of Bruno Simao Attorneys and Nicholas Brodie of SBL Incorporated discuss an important question concerning rental deposits and the interest payable to tenants.

A tenant wants the lease agreement to specify a fixed interest rate that will be earned on their rental deposit. The agent asks whether this is a reasonable request and how the landlord should deal with it.

The discussion looks at the Rental Housing Act and the provisions relating to rental deposits. Where a landlord takes a deposit, the deposit must be invested in an interest-bearing account with a financial institution, with the applicable interest being linked to the savings rate of that financial institution.

The discussion also considers whether a landlord and tenant can agree to a higher interest rate than the applicable savings rate.

You’ve drafted the breach letter correctly… but did you send it correctly? 👀

Your lease agreement will usually tell you exactly how legal notices must be delivered - and if the breach letter isn’t sent in accordance with that clause, it may not be regarded as valid legal notice.

In this video, Cilna explains why you should always check the notice clause in your lease, use the correct contact details, and make sure your breach letter is delivered exactly as agreed.

A small technical mistake at the start can create a much bigger problem later in the eviction process.
