⚖️ Beware of Approaching the Court with Ill Intentions: A Victory for Responsible Fatherhood ⚖️
In a recent children’s court matter, Director Combrink Nel and Candidate Attorney, Simoné Botha, had the privilege of representing a father who had been unfairly accused by the mother of the minor child. The allegations, though serious on the surface, were found to be entirely baseless upon thorough investigation and cross-examination.
The Social Worker’s Socio-Emotional Assessment Report, now part of the court record, brought crucial clarity to the matter. It not only discredited the false accusations but also uncovered a concerning pattern of manipulation and gatekeeping by the mother. Her intention was to limit contact with the child, but these attempts to withhold contact were not in the child’s best interest.
The court, in alignment with the social worker’s analysis and recommendations, ruled in favour of our client — the father — granting him increased contact and restoring balance to the child’s life. The Magistrate remarked on the mother’s conduct, emphasizing that courts will not tolerate the misuse of legal processes to serve personal vendettas and to the detriment of the child, withold contact on baseless accusations.
This matter serves as a strong reminder that:
✅ The best interests of the child remain paramount.
✅ False accusations harm not only the accused but the child as well.
✅ The court recognises and responds to ill-intentioned litigation.
This outcome was not just a legal victory — it was a personal one for our client and his child. It reaffirmed his role as a committed and loving parent, unjustly kept at bay. This interim order will now be closely monitored by the Social Worker and the progress will be reported back to the Magistrate at the next appearance.
