Ever worked with a difficult manager and wondered: “Is this just tough management… or actual workplace bullying/harassment?”

A 2023 Labour Court judgment draws a clear line on this important issue. The court dismissed a senior official’s claim of harassment under the Employment Equity Act, emphasising that not every unpleasant management decision amounts to unlawful conduct.

Key takeaway: For conduct to qualify as harassment, it must objectively impair dignity, create a genuinely hostile environment, and be linked to a prohibited or arbitrary ground. Ordinary (even unpopular) managerial actions like reassigning duties, managing performance, or declining requests usually don’t cross that line - provided they’re rational, consistent, and properly applied.

This case is a useful reminder for both employees and employers about where workplace dissatisfaction ends and legal claims begin.
