Mathapelo holds an LLB degree from the University of Pretoria. During her undergraduate studies, she was appointed as an Ordinary Judge and later served as Chairperson of the Clerks’ Committee of the Constitutional Tribunal at the University of Pretoria.

She has also been an active Mentor in the Pay-It-Forward Programme under the Moshal Program Scholarship South Africa, contributing to initiatives that support disadvantaged schools and communities through improved access to education, opportunities, and essential resources.

Can the previous registered owner of immovable property successfully rely on the Roman principle of fraus omnia vitiat, or “fraud unravels all”, which would entitle them to restitution of their property? This was the central legal question in a recent matter heard by high court.

The matter concerned an attorney who was struck from the roll of legal practitioners and the involvement of a trust with the attorney’s husband as the sole trustee thereof. The case illustrates familial fraud in everyday processes as well as the justice system’s strong reaction thereto.
