Do you work 24-hour caregiver shifts in California?

If you're required to stay in your client's home all day and overnight, you may be wondering:

Should I be paid for all 24 hours?

Many caregivers are told that overnight hours, sleep time, or "downtime" simply don't count. But when you're required to remain on-site, stay available, or wake up to provide care, those hours may affect what you should legally be paid.

Our latest article explains:

24-hour caregiver pay
Overnight and sleep time
On-call and waiting time
Flat daily rates
California overtime rules

If you think you've been underpaid, here's one thing you can do today.

Start collecting the information you already have.

Even if you were:

Paid a flat daily rate
Paid in cash
Never given pay stubs
Working overnight or 24-hour shifts
Employed by a private family

Simple records like your schedule, text messages, payment history, and care notes can be incredibly valuable when evaluating a potential wage claim. California's Labor Commissioner also encourages workers to provide any records they have, even though employers are generally responsible for keeping accurate time and payroll records.

Our latest article includes a step-by-step checklist to help you get organized.

If you're a caregiver, who is supposed to pay you—the family or the agency?

The answer isn't always as straightforward as many people think.

Depending on how you were hired and who controls your work, the legally responsible employer could be:

A private family
A home care agency
In some situations, more than one party may have legal responsibilities.

Our latest article explains:
✔️ Who is considered your employer
✔️ How California law applies
✔️ What to do if you're unsure who's responsible for paying your wages

"My employer never kept track of my hours, so I probably can't recover unpaid wages..."

We hear this from caregivers all the time.

The truth is, California employers are generally responsible for maintaining accurate time and payroll records. If they failed to do so, that doesn't automatically mean you lose your right to recover unpaid wages.

Even if you never:
✔️ Clocked in or out
✔️ Filled out a timesheet
✔️ Received pay stubs

You may still be able to prove your work schedule using:
• Text messages
• Calendars
• Care logs
• Payment records
• Your own reasonable estimate of your hours

Have you ever wondered how much unpaid overtime you might be owed?

Many California caregivers work:
• 12-hour shifts
• Overnight shifts
• Live-in schedules
• 24-hour care
..but receive the same flat daily rate no matter how many hours they work.

Our new California Caregiver Overtime Calculator can help you estimate whether you may have a claim for unpaid wages and overtime.

Even if you were:
✔️ Paid in cash
✔️ Never received pay stubs
✔️ Worked for a private family
✔️ Didn't keep perfect records

Your client is sleeping... but you're not free to leave.

You stay in the home.
You monitor their safety.
You wait in case they need help.

Does that time count as paid work?

Many caregivers believe they should only be paid when they're actively bathing, feeding, or assisting a client. But California law often focuses on whether you're required to remain available and under your employer's control—not just whether you're physically busy every minute.

Our newest article explains what every caregiver should know about waiting time.

Can your employer fire you simply for asking about overtime pay?

Many California caregivers are afraid to ask questions about their pay because they worry they'll lose their jobs.

The good news? California law provides important protections against retaliation for workers who ask about unpaid wages or overtime. Employers generally cannot legally punish employees simply for asserting their workplace rights.

Our latest article explains:
• What retaliation looks like
• When a termination may be unlawful
• What your rights are under California law
• What to do if you think you've been retaliated against

Do overnight caregivers get paid while they're sleeping?

The answer isn't always as simple as "yes" or "no."

If you're required to stay overnight with a client, remain available, or wake up to provide care throughout the night, California law may require that more of your time be paid than you realize.

Many caregivers are surprised to learn that overnight work, interrupted sleep, and on-call responsibilities can affect whether they are owed overtime or unpaid wages.
