The most common evidence in California domestic violence cases today is body camera footage, which records both audio and video of police contacts.

Police may also use text messages with threats, medical reports from ER visits, and pictures of wounds or injuries.

If you are arrested and have marks yourself, take your own pictures so the aging of those marks can be shown over time.

Domestic violence charges can come from physical contact like a slap, a push, a choke, or grabbing an arm hard enough to leave finger marks.

But threats are one of the most common sources of charges, and saying something like "I'm going to kill you" can be a felony criminal threat all by itself.

Taking someone's phone away while they are trying to call 911 can also qualify as a domestic violence charge.

Can a felony drug conviction be reduced to a misdemeanor under Penal Code 17(b)? Some can and some cannot.

Possession charges can be reduced from felonies to misdemeanors, and occasionally some other charges can too.

Possession for sale and sales cases under Health and Safety Code 11351, 11352, 11378, and 11379 currently cannot be reduced.

The biggest difference between misdemeanor and felony domestic violence is the amount of potential jail time.

A misdemeanor carries a maximum of six months or a year, while a felony can mean up to five years in prison and, in rare circumstances, up to eight.

A felony record is also worse than a misdemeanor record and can have more serious long-term effects on your life.

Although it is very rare, both partners can be arrested in a domestic violence case.

When that happens, each person has the right not to testify against the other and not to incriminate themselves, so the chance of a successful prosecution is pretty small.

When both partners are arrested, we are typically able to discuss the case with the DA's office and get it not filed in the first place.

When it comes to domestic violence in California, gender does not matter at all in deciding who is an intimate partner.

It includes anyone you have had at least a dating relationship with, either currently or in the past.

Even someone you share a now 20-year-old child with can still qualify, even if you have not been together for a long time.

Under Penal Code 1203.4, most California drug offenses can be expunged from your record.

Once your record is expunged, you can lawfully tell a private employer that you have not been convicted of an offense.

Government employers, like the FBI, the CIA, the County of Ventura, or the State of California, still require you to disclose the conviction and that it was expunged.

To decide who the primary aggressor is, police rely on what people tell them and photograph knuckles, fingernails, scratches, and bruises on both parties.

The person with the higher level of injury is usually treated as the victim, but sometimes the real initial aggressor ends up with fewer marks because the other person was defending themselves.

It is a hard call for police, and in our opinion, officers too often choose the male as the aggressor even when that is not appropriate.

Domestic violence charges in California come in tiers, starting with domestic battery under Penal Code 243(e)(1), which covers a push, shove, or slap that leaves no mark and is filed as a misdemeanor.

The next level, Penal Code 273.5, involves a mark or injury and can range from a misdemeanor for a small scratch or bruise to a felony for something like a black eye.

The most serious level involves great bodily injury, such as a broken bone, an injury requiring stitches, or loss of consciousness.
