Not always, but sometimes the best outcome is the one you didn’t get the first time.

Appeals aren’t about simply disagreeing with a result. They’re about identifying when the law was applied incorrectly and asking a higher court to take a closer look.

In California, appellate courts don’t retry cases. They review the record to determine whether legal error affected the outcome.

Understanding when an appeal is worth pursuing and how to present it effectively is exactly what appellate counsel is for.

No, I wasn't always the flourishing appellate lawyer you see before you. In fact, my very first job was at Blockbuster Video in Elkins Park, PA. 🎥

Now there is no more Blockbuster, and I'm no longer master of the VHS rewind station. 🥲 Although I was happy digging through the return bin and restocking shelves, I knew that I needed to grow and adapt to the technological environment that was booming around me. If only Blockbuster had adapted, too...

Litigators that don't adapt to using AI every day are already behind their peers. In my latest article, I'm breaking down practical ways trial and appellate lawyers can use large language models like ChatGPT, Claude, and Lexis+ AI to get more good work done.

The key is understanding what AI actually is: a language model that predicts and organizes text. It doesn’t exercise judgment. It doesn’t decide strategy. That's still the lawyer's job.

AI also can't definitively tell you if a particular new streaming service is worth the price, by the way. I've already tried to find that answer.
