Civil appeals can feel like they take forever. With an 18-month average waiting period in California, that feeling isn’t far from the truth. 📅

When faced with this reality, it’s natural for litigants to ask “Isn’t there some way to make this go faster?”

Sometimes, the answer is yes.

Certain California statutes allow qualifying cases to receive calendar preference from the Court of Appeal, helping move the appellate process along more quickly. In some situations, trial-setting preference may apply as well.

Another summary judgement reversed 🔄

The Court of Appeal reversed summary judgment in Doe v. Transdev Services, Inc., holding that triable issues existed regarding whether the alleged harasser qualified as a supervisor under FEHA and whether the employer took reasonable steps to prevent further harassment after receiving an earlier complaint about the same individual.

Our team argued that the facts remained sufficiently disputed that the case should be decided by a jury, not dismissed before trial.

Sometimes the right outcome is simply to let the jury decide.

Not always, but sometimes the best outcome is the one you didn’t get the first time.

Appeals aren’t about simply disagreeing with a result. They’re about identifying when the law was applied incorrectly and asking a higher court to take a closer look.

In California, appellate courts don’t retry cases. They review the record to determine whether legal error affected the outcome.

Understanding when an appeal is worth pursuing and how to present it effectively is exactly what appellate counsel is for.
