We're pleased to report that attorney Jim Yavorcik received a positive opinion from the 3rd District Court of Appeals earlier this week on a commercial truck insurance coverage case. A trucking firm utilized a driver who hadn't been approved by its insurance carrier or its underwriter. This driver got in a wreck with our clients and after the the loss, the carrier notified the parties that the driver was not a "permissive user" and that the policy limits would be reduced to "state minimums" of $25k/$50k per the terms of the policy.

Jim argued in the trial court that the meaning of the term "state minimums" for commercial trucks - even those operating solely intra-state - is $750k, as set by section 4921.09 of the Revised Code and corresponding regulations of the Administrative Code.

Judge Rowland of the Wyandot County Court of Common Pleas agreed with Jim's argument and his decision was unanimously affirmed by the Court of Appeals. The last total solar eclipse visible in Toledo was in 1806. The next one won't be visible in Toledo until 2099. As the Glass City finishes gearing up for the total solar eclipse next Monday, April 8th, we hope you and your family can enjoy this once in a lifetime event. Please be advised that our office will be closed on April 8th and will reopen on April 9th.

Research regarding the 2017 solar eclipse found a 31% increase in traffic risks around the time of the eclipse, similar to the increase in risk around other holidays like Thanksgiving. In absolute terms, this is an average of 1 extra crash-involved person every 25 minutes and 1 extra crash fatality every 95 minutes. People are more likely to be distracted, driving on unfamiliar roads, and speeding to arrive at their destination on time. They may also be intoxicated from eclipse-related celebrations, or may choose to view the event from unsafe roadside locations. Here’s some safety tips in order to make your total solar eclipse experience safe and enjoyable:

Snow, ice, and subzero temperatures have made an appearance in Ohio and Michigan the last week! When icy roadways are involved, the most important thing you can do to avoid a motor vehicle collision is not drive at all. When you can't avoid driving, here are some general tips/reminders to stay safe on the roads this winter:

• Have proper winter tires and make sure they're properly inflated.

• Slow down. If you do go into a skid, you’re less likely to do your vehicle or yourself damage.

• Increase your following distance. You’ll need much more stopping distance compared to what you’re used to on dry pavement.

• Be extra vigilant on bridges, overpasses, and ramps. They’re the first to freeze and the last to thaw.

• Accelerate and apply brakes slowly.

Worry is often your closest companion if you’re a parent, grandparent, or love and care for a child. Unfortunately, it just comes with the job. November is National Child Safety and Protection Month and the perfect time to review some key safety considerations as well as ways you can help minimize any risks.

Fact: In 2020, 607 children under 12 died in motor vehicle crashes, and more than 63,000 were injured. Of the children killed, 38% didn’t have their seatbelts fastened.

What you can do: Without exception, make sure children are properly buckled in car seats, booster seats, or seat belts and that car seats are appropriate to their age and size.

October is National Pedestrian Safety Month. According to the NHTSA (National Highway Traffic Safety Administration), the number of pedestrians killed in traffic crashes in 2021 was 7,338, the highest number since 1981. It's unclear what the cause of this alarming increase in pedestrian deaths is but we encourage everyone to put their phones down and slow down while driving. The NHTSA Pedestrian Resource Guide, which is linked to this post, has interesting information regarding the issue and potential solutions that would make roads safer for pedestrians.
