Evergreen Personal Injury Counsel recently secured a $6.8 million settlement against a general contractor stemming from serious worksite safety violations that resulted in catastrophic injuries to an adult roofer.

The settlement resolves claims arising from an incident in which the roofer sustained polytraumatic injuries while performing roofing work without proper training, supervision, or adequate safety protections. An investigation determined that the general contractor failed to implement and enforce required safety protocols for its nondelegable duty to provide a safe place to work and oversite of its subcontractors, creating dangerous working conditions that directly led to the injuries.

This resolution underscores the legal and financial consequences of ignoring established safety standards and highlights the critical responsibility contractors have to ensure all workers are properly trained, supervised, and protected on construction sites.

Evergreen Personal Injury Counsel represents two women who suffered severe injuries at Point Ruston. Both falls occurred on the steps of the Grand Plaza — Point Ruston’s centerpiece which invites visitors to the waterfront and children’s play areas.

During our investigation, EPIC has learned that Point Ruston Owners Association owns and maintains the steps. After analyzing the falls and the steps, EPIC uncovered that the steps fail to comply with any building code, in that the steps rise and run is significantly outside safe parameters. The steps also lack handrails. These hazards were compounded by the fact that the Grand Plaza steps were constructed of a monochrome dyed concrete, which effectively camouflaged the steps edges.

Apparently, our client’s falls are not isolated events. Recently, after report of another fall and injury on the Grand Plaza steps, Point Ruston Owners Association made its first attempt in improving safety by painting the nosing of the steps to add visibility and contrast. While recent efforts to improve visibility are a step in the right direction, more must be done to ensure that this popular community gathering space is truly safe for all who visit.
