On May 27, 2026, the firm learned that one of two objectors delaying distribution of settlement funds, Donald Birner, who is proceeding without counsel, appealed to the U.S. Supreme Court. Hagens Berman’s legal team will continue to provide updates as information becomes available.

As previously shared, we understand that settlement payments are greatly anticipated and wish we had better news for the millions of class members held up by these objections. We continue to ask class members for their patience.

On May 12, 2026, the firm filed a petition for writ of habeas corpus and declaration on behalf of Prakash Kadel, a 36-year-old noncitizen from Nepal currently in the custody of Immigration and Customs Enforcement (ICE) at its center in in Tacoma, Wash. Mr. Kadel was detained at the U.S.-Mexico border and has been held for over 16 months, “under constant fear of armed guards,” effectively imprisoned.
