In Washington state, you can be charged with driving under the influence of intoxicants if you’re caught “operating a vehicle while affected by alcohol, drugs or both,” the Washington State Department of Licensing said. “This applies to both legal and illegal drugs, including prescription medication and over-the-counter drugs,” the state agency said. Specifically, it’s illegal to have a blood alcohol concentration of 0.08 or higher or a THC concentration of 5.00 within two hours after driving a vehicle, according to the Revised Code of Washington. If it’s clear substances have impacted your driving, you can still be charged with a DUI, regardless of what blood tests show.
