Fitzgerald Knaier is pleased to welcome back associate Brittany Vojak to our practice. After trying two cases with Ken Fitzgerald in 2020 and 2022 (COVID produced a mistrial of the first one), Ms. Vojak left the firm in 2023 to serve as in-house counsel at SCW Contracting Corp., a San Diego-based construction company. During her time there, she honed her skills negotiating private and public construction contracts, resolving disputes with municipalities, owners, contractors, subcontractors, and vendors, and handling HR and employee-related matters. Her broad range of experience and business insights will serve our litigation clients well, as we work to win their cases and help solve their problems. We are glad to have her back on the Fitzgerald Knaier team!

Yesterday, the Hon. M. James Lorenz of the U.S. District Court for the Southern District of California granted summary judgment to California Attorney General Rob Bonta and related State of California defendants, in a Second Amendment challenge to California Penal Code section 27510 - which prohibits licensed fi****ms dealers in California from selling long guns and semiautomatic rifles to people under the age of 21.

The law was enacted in response to the mass shooting by 19-year-old Nikolas Cruz at Marjory Stoneman Douglas High School in Parkland, Florida. Judge Lorenz held that the gun safety law is Constitutional, rejecting the contention by plaintiffs that the statute violates the Second Amendment.

Our firm was proud to help represent amicus Everytown for Gun Safety Support Fund in this case, Chavez v. Bonta et al., U.S. District Court Case No. 19-cv-1226-L-AHG (S.D. Cal.).
