It is unlawful for an employer to even attempt to enforce a non-compete agreement in California. In fact, an employer could be sued for requiring employees to sign a non-compete agreement or attempting to enforce it, including being required to pay attorney's fees. Often employees are concerned that their employers will try to enforce "non-compete" agreements and prevent them from finding new employment with a competitor or employer in the same industry. With very limited exceptions, California does not limit an employee's right to work and does not enforce non-compete agreements. It is always important for employers and employees to know the law.
