You remembered the clothes, medicine, school schedule and emergency contacts.

But did you leave the person caring for your child the legal authority they may need in an emergency?

It’s one of those things parents rarely think about—until they need it. ⚖️🤍

Saturday we talked about custody.

Sunday we talked about a minor child’s inheritance.

And today I want to put those two conversations together.

Because if you’re raising minor children, your estate plan needs to contemplate more than:

“Who gets my house and my money?”

It should make you think about:

Who would I want caring for my children?

Who would I trust managing assets for them?

Are those actually the same person?

And how do I want my children’s inheritance handled while they’re young?

These aren’t fun questions.

But they’re questions I’d much rather have you answer than leave completely unanswered during one of the hardest moments your family could ever experience.

You don’t estate plan because you expect something to happen.

You estate plan because you’re the parent—and you still get to make the plan. ⚖️

Save this one and talk about it with the other parent tonight.

Your sister knows.

Your parents know.

Your best friend knows.

You’ve even said:

“If anything ever happens to us, I want you to take the kids.”

Having that conversation matters.

But when we’re talking about your children, your property and potentially years of managing an inheritance, don’t make your family rely solely on remembering what you said.

Put your wishes into a proper estate plan.

Because the people you love shouldn’t have to piece together your intentions while they’re grieving. ⚖️

Have the conversation. Then document the plan.

**Your child can inherit your money.

That doesn’t mean your child can manage it.**

And the situation involving Hayden Panettiere’s 11-year-old daughter is a really good example of why that distinction matters.

Kaya is reportedly the sole heir to her mother’s estate. Her father, Wladimir Klitschko, is now asking a California court for authority to act on Kaya’s behalf and protect her inheritance while the estate is being handled. (AP News)

It brings up a question every parent of a minor child should think about:

If something happened to me tomorrow, who would actually manage what my child inherits?

Not just who gets the house.

Not just who is listed as beneficiary.

Not just who takes care of your child.

Who controls the money?
How can it be spent?
And when does your child get control of it?

Those are estate-planning questions too.

Because “my kids get everything” may tell us who you want to inherit.

It doesn’t necessarily tell us how you want them to inherit.

The headline sounds pretty definitive:

Halle Berry’s parenting time was restricted.

But legally, there’s a HUGE distinction between a temporary order and a final finding. ⚖️

Olivier Martinez has made serious allegations involving their 12-year-old son. Berry strongly denies them. A California judge has temporarily restricted Berry’s parenting time while the case proceeds toward another hearing. (People.com)

That does not mean a court has finally determined that the allegations are true.

And that’s the part of emergency family law that can be confusing from the outside.

Sometimes a court has to decide what happens right now before it can decide what should happen long term.

Texas procedure is different from California’s, but we have temporary-order procedures here too.

So when you see a dramatic custody headline, pay attention to three words:

Temporary. Alleged. Pending.

They can completely change what the headline actually means.

This is one of those family-law distinctions that gets completely lost in a headline. ⚖️

A judge granting temporary relief does not automatically mean the judge has decided every allegation is true.

Temporary orders address what happens while the case is still unfolding.

The fuller determination comes after the parties have the opportunity to present their evidence and arguments.

Temporary ≠ permanent.
Allegation ≠ finding.

And that distinction matters.

Your lawyer can advocate for you without being the person who helps you process every emotion that comes with your case. ⚖️

Family law is personal. It’s stressful. And sometimes it brings out emotions you didn’t even know were there.

A good attorney helps you separate the legal decisions from the emotional ones—because the two don’t always lead you to the same place.

And sometimes the strongest thing you can do is build a team that supports both. 🤍

A good lawyer + a good therapist can be a pretty powerful combination.

Some of the hardest fights I see in family law aren’t necessarily over the most valuable property.

Because once a marriage ends, things can stop being just things.

The house can represent the future you thought you were going to have.

The furniture can represent who gets to keep the life you built.

And sometimes an object neither person cared much about before becomes incredibly important the second the other person wants it.

That doesn’t make the emotion behind the fight insignificant.

But there comes a point where you have to separate what something means to you from what fighting over it is going to cost you.

Your lawyer can help you understand the legal and financial side.

Only you can decide when the emotional price has become too high. ⚖️

One of the most expensive phrases in family law can be:

“I don’t care what it costs.”

Your attorney’s fees are an asset too.

Before spending thousands fighting over property, know what the property is actually worth—and why you’re fighting for it.

Sometimes it makes financial sense to fight.

Sometimes it doesn’t.

Knowing the difference matters. ⚖️
