One of the most common estate planning misconceptions we encounter is that people believe their assets are automatically protected once a trust is created. However, that’s not the case. A trust must be properly funded to be effective, which means that you need to transfer the assets you want to protect into it. Without that step, those assets will likely still go through probate.

With the arrival of a new year comes an opportunity to reflect on what’s changed in your life and what needs updating. Estate plans generally need regular updates, but it’s especially important for Americans to review their estate plans this year.
