Our Case of the Month comes to us today from Attorney Bruce Franson:

"Hank was installing drywall as part of a large project, building several houses in a new subdivision. As he was carrying two buckets of drywall mud down to the basement, the temporary stairs built by a different subcontractor collapsed. Hank fell about ten feet, landing on his back. Hank was taken to the hospital by ambulance where he had several x-rays and CT scans. Fortunately, Hank's injuries were not so severe as to need surgery, but he ended up out of work for several weeks. Hank's claim was complicated by the multiple different subcontractors involved, none of whom wanted to admit they built faulty stairs, and the fact that as a lifelong drywall installer, Hank already had a history of soreness and mild injuries to his back. By doggedly pursuing each of the subcontractors until they finally admitted the facts, and by standing firm with the at fault insurance as they tried to avoid liability, we were able to settle Hank's case for over $100,000.00, affording him the necessary financial stability to care for himself and his family as he recovered from his fall."

Hank’s case wasn’t easy. There were multiple contractors, no one wanted to take responsibility, and his history of back pain gave the insurance company an excuse to downplay his injury. But we stuck with it, uncovered the truth, and made sure Hank got the financial support he needed to take care of himself and his family.

asked a great question on Instagram: “What happens if I get injured in a hit and run accident?”, and Attorney Zeb Weeks is here to break it down for us.

Many people don’t realize this, but your own auto insurance policy can actually protect you if you’re hit by a driver who doesn’t have insurance, or who takes off and can’t be found. In Utah, uninsured motorist (UM) coverage can help protect you when the at-fault driver disappears or doesn’t have insurance coverage.

Fun fact: in Utah, you can only reject UM coverage by signing a special waiver form from your insurance company (which you should never do!) So unless you remember doing that (like, actually signing something that spelled it all out), there’s a good chance you have it, and it might be the only thing standing between you and a mountain of medical bills if you’re involved in a hit and run accident.
