What does it mean to have testamentary capacity? ⚖️

When making a Will, a person must be able to understand what they are doing, the assets they have, and the people who may reasonably expect to benefit.

Being elderly or unwell does not automatically mean someone lacks testamentary capacity.

Understanding the legal requirements can make all the difference when it comes to protecting your wishes and your estate.

Under Family Provision law, certain people may be able to make a claim against an estate if they believe the Will, or the rules of intestacy, have not made reasonable financial provision for them.

Depending on the circumstances, this can include a spouse or civil partner, child, former spouse, or someone who was financially dependent on the deceased.

The court will consider the individual circumstances and whether reasonable financial provision has been made.

Think you may have a claim? Understanding your rights is the first step.

True or False? Family disagreement can make a Will invalid. ⚖️

False.

Simply disagreeing with the contents of a Will does not make it invalid.
However, a Will may be challenged in certain circumstances, for example, if there are concerns about undue influence, lack of testamentary capacity, or whether the Will was properly executed.

A family dispute and an invalid Will are not the same thing.

Tenancy in Common vs Joint Tenancy: What’s the difference?

When two or more people own a property together, the way they own it can affect what happens to their share when they pass away.

Joint Tenancy - If one owner passes away, their interest generally passes automatically to the surviving joint owner(s), rather than through their Will.

Tenancy in Common - Each owner has a separate share in the property. That share can generally be left to someone else in their Will.

đź’ˇ Why does it matter?

The type of ownership can directly affect your estate plan and who ultimately receives your share of the property.

A small detail in how a property is owned can make a big difference to what happens next.

Is your Will older than your phone? đź‘€

If you can remember when you last upgraded your phone, but not when you last reviewed your Will, it might be time for a check-in.

Life changes. Your estate plan should keep up.

🍂 This autumn, take a few minutes to review your Will and make sure it still reflects your wishes.

Ever heard of a Caveat? 👀⚖️

In probate, a caveat can temporarily stop a Grant of Probate from being issued, giving someone time to raise concerns about the estate.

A small legal term that can have a big impact.

When an estate doesn’t have enough assets to cover all outstanding debts, what happens next? ⚖️

Not all debts are treated the same, and the order in which claims are paid can matter. The executor may need to identify the estate’s assets and liabilities, determine which claims take priority, and distribute what remains according to the applicable rules.

Understanding how an insolvent estate is handled can help families avoid costly mistakes.

Once the estate’s debts, taxes, and administration expenses have been addressed, what happens to what remains?

Distribution of the estate refers to the process of transferring the remaining estate assets to the beneficiaries entitled to receive them.

The distribution must follow the terms of the will or, where there is no valid will, the applicable rules of intestacy.
