The Trump administration is currently developing a new Department of Homeland Security (DHS) plan that could dramatically change how asylum cases are handled.
If implemented, this proposal would allow USCIS to reject certain asylum applications without conducting an interview first.
Here is what you need to know about the proposed changes:
✅The proposal specifically focuses on asylum applications filed more than one year after an applicant’s arrival in the United States.
✅How It Changes the Current Rules: Right now, asylum officers generally interview applicants to see if they qualify or if they meet an exception to the one-year deadline. Under the new plan, officers could deny the case upfront if they believe it is barred by the one-year rule, skipping the interview entirely.
✅The Consequences: If an application is rejected under this rule, the applicant would be placed directly into removal proceedings before an immigration judge.
✅The Stated Goal: The administration is aiming to curb the massive backlog. Currently, USCIS is facing roughly 1.5 million pending asylum applications, while immigration courts are overwhelmed with 3.3 million pending cases (2.3 million of which are asylum-related).
