This week Nicholas Bustamante appeared on behalf of two Unite Here organizers who were arrested while protesting and advocating for fair wages for ASU Aramark employees. Our office has asked that MCAO decline prosecution, as the two were arrested while on a public sidewalk and engaging in lawful first amendment activity. We hope that MCAO does the right thing and declines prosecution but we are ready to defend the case and protect the public’s fundamental right to freedom of speech.

Not every case has a happy ending but this one certainly did!

We had an undercover officer tasked with investigating “illicit massage parlors.” His investigative techniques, however, seemed to involve a bit too much personal participation.
After ducking us for nearly 9 months, we filed a motion compelling him to a deposition. During the deposition he admitted he had his p***s oiled up and tugged, by a possible victim of human s*x trafficking. This is not how these operations are supposed to occur, his conduct was a felony.
To make matters worse, crucial video evidence from the case mysteriously vanished. But you can’t hide the truth forever!

Based on the officer’s testimony and the destruction of evidence, we prevailed on a motion to dismiss.

This also paved the way for other co-defendants to have their pleas withdrawn and convictions overturned.

Let’s talk about the Fourth Amendment. It’s one of our most basic, yet incredibly important, protections against government actions.
Nicholas recently had a client who was in a tough spot, facing the highest sentencing category. Police found him passed out at an intersection, pulled him from his car, restrained him, and then performed a search.
What seemed like a simple arrest quickly became a complex issue. After diving deep into hours of video footage. Nicholas found a significant search issue. By trusting his client’s account and applying his knowledge of case law, Nicholas was able to file a motion to suppress the evidence.
The best part?
The case was ultimately dismissed. This just goes to show how critical it is to understand your rights and have someone meticulously review every detail.

Big news to share!

We have been in business for nearly seven years. Starting from a tiny closet-sized office in a coworking space by myself, and eventually growing to three of their biggest offices there, we have reached a new milestone.

I’m incredibly excited to announce that I have purchased our very own building for the firm! It’s been a journey and honestly, I couldn’t have done it without the amazing support of my brilliant wife, my friends, mentors, and family.

This isn’t just a new office, it’s a beautiful old-school building, about 120 years old with so much character. It’s got that Clarence Darrow-esque vibe with gorgeous old wood throughout.

After completing a bunch of renovations we are having our grand opening in May.

While many cases do end with a plea offer, especially here in Maricopa County, Nicholas Bustamante points out a crucial detail: sometimes accepting a felony plea means you haven’t even had access to all the evidence yet! That’s why it’s so important to really dig in. Unless it’s an absolutely amazing offer that minimizes all risk.

Nicholas and the team believe in preparing as if they’re going to trial. This means thoroughly reviewing all the evidence, talking to investigators, and working closely with clients to find issues that can help turn a good plea offer into an even better one.

Victories like these are hard to come by. Richard had been out of prison already for three years. Turned his life completely around. He has a phenomenal job, loving spouse, and was mentoring and sponsoring other men when he was charged with two separate major felony cases from before his prison sentence. We came in and found numerous constitutional violations and significant trial issues in both cases and were able to get them both dismissed.

Someone recently said to me this job is often doing the impossible for the ungrateful. Richard was beyond grateful. He made the time to come down and thank us in person for what we did. It’s things like this that keep us going!
