A lot of people believe that if they’ve been drinking, they can simply “sleep it off” in their car and avoid a DUI. But in Arizona, you don’t have to be driving to be charged.

👉 The law also covers “actual physical control.”
That means if the State can prove you were in control of the vehicle while impaired - even if you never moved an inch - you could still face DUI charges.

Examples that can raise red flags:
🔹 Keys in the ignition or nearby
🔹 Car engine running (even for AC/heat)
🔹 Sitting in the driver’s seat with access to controls

💡 If you ever have to wait it out, the safest plan is to avoid the driver’s seat and avoid any indication you’re about to drive.

There are defenses to an actual physical control case so if you’re charged with being in actual physical control make sure you hire an attorney who knows how to defend you.

If you are stopped and suspected of DUI the officer may ask you to perform a series of tests such as:
- Follow a pen with your eyes (HGN)
- Walk a straight line
- Stand on one leg

These are called field sobriety tests and here’s what most people don’t realize:

➡️ They’re voluntary in Arizona.
➡️ They’re not designed to prove your innocence.
➡️ They exist to support an arrest and help prosecutors build their case.

You can politely decline to perform them.
The officer will either have enough evidence for an arrest or they won’t.
