Ms. Melendez was the first client I ever met with face to face as a brand new lawyer in 2017. She had been let down by her doctor, her complaints dismissed, downplayed and ignored. By the time the mass in her spine was diagnosed, the damage was done. She now lives as an incomplete paraplegic, life turned upside down.

We spent years litigating the case, gathering documents, and taking depositions. By the time of trial in Fall 2022, the defendant health system wouldn’t offer a fair amount to settle the case. So we picked a jury and went to trial. I will never forget the snide, sarcastic remark the older defense lawyer made to me after I gave my closing argument: “I really can’t wait to watch you improve as a lawyer, Tom,” she said as she chuckled and walked away.

The jury came back in our favor over $19 million. The largest medical malpractice jury verdict in Pennsylvania that year at the time. But the defense wouldn’t let up. They appealed, asking the Pennsylvania Superior Court to wipe away the verdict or give them a new trial. For over 3 years, my client has been patiently waiting on this appeal.

We just learned the Superior Court upheld the verdict in its entirety and rejected all the defendant health system’s arguments. At this point, with the addition of post-judgment interest and delay damages, the total amount owed is over $28 million.

The courtroom is one of the only places left in our democracy where the everyday person can hold to task wrongdoers, no matter how rich powerful.
