Most people think estate planning is about what happens when you die.

It's only half the picture. Your will and trust handle death. Your power of attorney and healthcare directive handle incapacity. Together, the four documents cover every scenario.

Remove any two and you have a plan that only works if you die cleanly โ€” no medical crisis, no period of incapacity, no time when someone needs to act on your behalf.

That is not a complete plan. The four documents are not separate legal things. They are one system. And the system only works when all four are in place.

Without an advance healthcare directive, California law decides who makes your medical decisions for you.

It follows a default hierarchy. Spouse first, then adult children, then parents, then siblings. But families under the stress of a medical crisis don't always agree. And if they can't, the medical team may have to seek a court-appointed conservator. That process takes time that a patient in a medical crisis may not have.

Your directive fixes all of it. It names one person you trust, tells them exactly what you want, and eliminates the disagreement before it starts.

But if you become incapacitated and cannot speak for yourself, your doctors and your family need answers. An advance healthcare directive gives them both.

It names someone you trust to make medical decisions on your behalf. And it documents exactly what you want, so those decisions are guided by your voice, not their assumptions.

It's easier to plan this now than to leave it to chance.

The IRS doesn't pause for medical emergencies. Your 1031 exchange deadlines keep running whether you're in the hospital or not.
