A trust only controls what's actually titled in its name. One of the most common and most expensive gaps we see is a home that was never formally transferred into the trust, which can send the largest asset in an estate straight into probate anyway.

As the year winds down and families start spending more time together, it's a good moment to double-check that the deed matches the plan. A quick review now is a lot simpler than a court petition later.

When a home becomes part of a probate estate, what actually happens to it? Ownership doesn't simply transfer the moment an owner passes away.

Until administration is complete, the property generally stays under the personal representative's watch, and that comes with ongoing duties.

Those can include keeping appropriate insurance in place, securing and maintaining the house, obtaining the valuation the court requires, and staying current on costs such as the mortgage, property taxes, utilities, and upkeep. If a sale becomes necessary, it has to follow the proper court procedure rather than a standard listing timeline.

In the Bay Area, a residence is often the most significant asset in an estate, which makes the probate requirements around it especially important to get right.

Radiant Probate & Estate Law, Inc. works with executors and administrators in Palo Alto, Santa Clara County, San Mateo County, and Santa Cruz County on questions like these.

Being named to handle a loved one's estate can feel like an honor… and then the actual to-do list shows up.

Serving as the personal representative of a California estate involves far more than filing paperwork with the court. Depending on what the estate holds, the work can include any of the following:

▪️Coordinating a complete inventory of estate assets
▪️Arranging the appraisals the court requires
▪️Addressing creditor matters and evaluating claims
▪️Maintaining and insuring real property
▪️Managing tax filings and outstanding bills
▪️Meeting court requirements and deadlines
▪️Keeping beneficiaries informed along the way

Most people take all of this on while still juggling their own job and family.

Picture an estate that includes a home, a few financial accounts, personal belongings, ongoing monthly expenses, and several beneficiaries. Each piece follows its own administrative path, and they rarely move at the same pace.

If you've recently stepped into this role, probate counsel can help you understand what needs to happen, in what order, and which responsibilities are genuinely yours. Radiant Probate & Estate Law, Inc. has guided executors and administrators through the court-supervised process since 2011.

Probate gets expensive before the process even really begins, and those court costs tend to land on a family at the worst possible moment.

At Radiant Probate & Estate Law, we pay those costs up front, often up to $2,000, and get reimbursed by the estate. That's one less obstacle standing between a grieving family and getting the process moving.

If starting costs have been holding you back from opening a probate matter, let's talk it through. Call our Palo Alto office at 650-493-9200 to schedule a free consultation.

Named as a trustee or an executor and not totally sure what that means? You're not alone, and mixing up the two roles is one of the most common misunderstandings we see.

An executor is named in a will and answers to the probate court. A successor trustee is named in a trust and generally administers the estate privately, outside of court supervision.

The paperwork, timelines, and the authority each role carries are different. What doesn't change is this: both roles come with personal responsibility to get things right.

If you've been named to either one and aren't sure which applies to you, that's the first question worth answering before you do anything else.
