In the news!

The U.S. International Trade Commission said Wednesday that it will be investigating Black & Decker's stud finders, metal detectors and electrical scanners, after receiving a complaint from a California manufacturer alleging that the company is importing and selling infringing products.

Pursuant to CCP 1010.6(b)(3), the deadline to file electronically is 11:59:59 p.m., to receive the benefit of the same day.

CRC, Rule 2.252(a) confirms this.

Administrative Presiding Justice Jim Humes, Associate Justice Sandra Margulies, and Associate Justice Kathleen Banke of the California Court of Appeal, First Appellate District, Division One, issued an Order today DENYING Petitioner Mustafa Board’s Writ of Mandate. (Case No. A159771).

The Appellate Court held that Petitioner lacked standing to bring the Writ, thereby effectively confirming Alameda County Superior Court Judge Evelio Grillo’s January 27, 2020 Order recognizing the Board of Directors and Members of ISEB.

This effectively concludes, in our client’s favor, seven years of litigation (and six separate lawsuits filed against our clients).

Congratulations to the Chairman of the Board of Directors and President Jamal Qureshi on a job well done. Your strategic thinking and leadership proved invaluable during this process.

Special thanks to Attorneys Carl Sundholm on the appellate briefs and V. Torch Sathienmars during the underlying trial.

After 6 separate lawsuits, 6 years of litigation, 1 arbitration, a separate mini evidentiary proceeding before a retired Judge of Santa Clara County, and a bench trial in Alameda County Superior Court, congratulations to Attorneys Omair Farooqui, Carl Sundholm, and V. Sathienmars and Mr. Jamal Qureshi on obtaining a favorable Final Order today.

On November 19, I argued before the California Court of Appeals, Sixth Appellate District on an appeal filed against our client Mr. Shivji in Heimlich v. Shivji (Case No. H043082).

Today the Appellate Court issued an opinion and DENIED the appellant relief and ruled in favor of our client.

Congratulations to the PALG team for a job well done!

Plaintiff filed an Application for Right to Attach Order and Writ of Attachment against our client seeking an attachment order in excess of $74,000. Plaintiff boasted of having a 98% success rate in over 100 similar applications...

We opposed and the Court DENIED plaintiff’s application on the merits.

Congratulations to the PALG litigation team for a job well done!

After being turned down by 10 separate firms, our client retained us to set aside a $500K default that was entered against him in March 2019. Plaintiff’s counsel refused to set aside the default, prompting us to file a Motion to Set Aside. Initially, the Court’s Tentative Order ruled against our client.

However, on Monday after oral argument, the Court reversed its Tentative and GRANTED our Motion. Congratulations to our team for a job well done!

Rule: DO NOT WAIT. If you have a Default entered against you, EVERY DAY is critical. Seek counsel IMMEDIATELY!!!

Our client was being sued in a real estate dispute in Alameda County Superior Court. The Court today GRANTED our motion for summary judgment, dismissing Plaintiff’s Complaint. Congratulations to our litigation team for a job well done.
