When one spouse passes away, the surviving spouse may be able to use the deceased spouse’s unused federal estate tax exemption. This concept is called portability.

An important detail: portability requires a timely-filed federal estate tax return to elect it, even if no estate tax is otherwise due.

For many families, this is a “do not miss the deadline” conversation.

If estate tax planning or portability questions are on your radar, we would be glad to review your situation with you: www.clc.esq

Estate administration simply means handling someone’s affairs after they pass away. There are two broad categories of assets:

🔹Probate assets, which often require court involvement
🔹Non-probate assets, which pass by title or beneficiary designation

Early steps usually include:

🔹Locating important documents
🔹Identifying the Personal Representative
🔹Listing financial accounts
🔹Securing real property
🔹Tracking ongoing bills and expenses

It is paperwork-heavy, and there are procedural requirements, but it is manageable with steady guidance.

If you find yourself in this role, you do not have to navigate it alone. We’re here to help.

We sometimes hear, “Why not just give everything away now?” The short answer is timing matters.

When long-term care planning and Medicaid eligibility are involved, transfers made within certain time periods can create penalties. Giving assets away without understanding the lookback rules may limit your options later.

Planning early provides flexibility. Waiting for a crisis often narrows the choices available.

If you have questions about timing and long-term care planning, let’s have the conversation before decisions feel urgent: www.clc.esq

When a family includes a loved one with disabilities, estate planning requires extra care.

A Special Needs Trust can help provide financial support without disrupting eligibility for benefits such as SSI or Medicaid, when structured properly. At a high level, a Special Needs Trust can:

🔹Supplement government benefits rather than replace them
🔹Provide funds for quality-of-life expenses
🔹Offer long-term oversight through a carefully chosen trustee

Important decisions include:
🔹Who should serve as trustee
🔹What assets will fund the trust
🔹What types of expenses the trust should cover

There is no one-size-fits-all solution. Each family deserves a thoughtful, individualized strategy.

If this is part of your planning picture, we would be glad to discuss it with you.

One client recently shared how much they appreciated building charitable giving strategies directly into their revocable living trust.

They valued having comprehensive estate planning guidance that addressed both family and philanthropy in one coordinated plan.

The simple takeaway: mention your giving goals early. When charitable intent is part of the conversation from the beginning, the plan can be structured to support it properly.

If charitable planning is on your mind, we’re happy to talk through the options with you: www.clc.esq

You can support the causes you care about and provide for your family. It does not have to be one or the other.

If philanthropy is important to you, here are three simple starter options to discuss:
🔹A specific dollar bequest
🔹A percentage gift of your estate
🔹Charitable provisions inside a revocable living trust

One important reminder: beneficiary designations on retirement accounts and life insurance should align with your overall estate plan. Those forms can override other documents.

Planned giving is about transferring values, not just valuables. If leaving a legacy matters to you, let’s structure it clearly and intentionally.

If you create a revocable living trust, assets must be properly titled into the trust. That step is called funding, and it matters more than many people realize.

A trust only controls what it actually owns. Here are a few items we typically review with clients:
🔹Your home deed
🔹Bank and brokerage accounts
🔹Beneficiary designations on retirement accounts and life insurance

If ownership is not aligned with the plan, probate may still be required.

Implementation support is part of the conversation. If you are unsure whether your trust is fully funded, let’s take a look together: www.clc.esq

A recent client came to me during retirement and a relocation to the Bethany Beach area. Like many people making a move, they realized their estate plan needed updating.

What mattered most to them was not just the documents. It was the process.

🔹Patience
🔹Clear explanations
🔹Time to understand trust decisions
🔹Feeling supported from start to finish

That is always our goal: steady guidance, plain-English conversations, and enough time for you to feel confident in every decision.

Most people think estate planning is about “who gets what.” It really comes down to three things:

🔹Who receives your assets
🔹How quickly everything moves
🔹How much court involvement happens

Without a plan, state law decides. And in Delaware and Maryland, that may not work the way you assume. Probate is also a public process, which means certain information becomes part of the public record.

And planning is not just about having a Will. If you become incapacitated, the right documents can help your family avoid unnecessary court involvement during your lifetime.

If this has been sitting on your to-do list, let’s make it simple. We offer complimentary consultations to help you understand your options: www.clc.esq
