04. TPS for Haiti Has Ended: What New York Families Should Review Now

For many Haitian families in New York, Temporary Protected Status, or TPS, provided protection, work authorization, and a sense of stability for many years.

When TPS for Haiti ended on July 27, 2026, the impact was immediate and deeply personal.

It has affected work, housing, driver licenses, family finances, travel decisions, pending immigration cases, and the ability to plan for the future.

The most important thing to know is this:
The termination of TPS for Haiti is serious. However, people should not assume they have no options until their full immigration history has been reviewed by a skilled immigration attorney.

TPS for Haiti ended after a period of court challenges, government updates, and shifting deadlines. DHS (Department of Homeland Security) terminated the program effective July 27, 2026.

That means many former TPS holders are now facing uncertainty about work authorization, protection from removal, and next steps.

When TPS ends, it can affect more than immigration paperwork. It may affect employment verification, driver license renewal, pending applications, travel, family stability, financial planning, and future immigration strategy.
That is why this may be an important moment to ask:

Was TPS my only option, or is there another immigration path available?

Former TPS holders may need to review family-based immigration, marriage-based green card eligibility, adjustment of status, consular processing, prior petitions, pending applications, asylum eligibility, waivers, humanitarian options, immigration court history, prior entries and exits, and criminal history, if any.
The goal is not to create fear. The goal is to understand the full picture.

Some people may have options they do not know about. Others may have risks that should be understood before filing anything new.

At BLMT Immigration Law (Previously Bean, Lloyd, Mukherji, & Taylor, LLP), we help individuals and families understand their options, assess risk, and prepare carefully before making important immigration decisions.

03. El Salvador TPS: What the September 9 Announcement Means for Bay Area Families

For many Salvadoran families in the Bay Area and beyond, Temporary Protected Status, or TPS, is not just an immigration status.

It can affect work authorization, driver licenses, housing, family unity, travel decisions, and the ability to plan for the future.

That is why the September 9 deadline created so much concern. Many Salvadoran TPS holders were waiting to hear whether protection would end or continue. Instead, the announcement that followed left many people with more questions than answers.

The most important thing to know is this:

If you have TPS from El Salvador, this is not the time to rely on rumors. It is the time to understand what is known, what is still unclear, and whether you may have other immigration options to review.

TPS for El Salvador had been set to expire on September 9, 2026. Because DHS (Department of Homeland Security) did not make a decision on the termination or extension of TPS by that date, it is automatically extended by law for six months. That would carry protection through March 9, 2027.

For now, protection and work authorization remain in place. But that should not be confused with permanent status or a guaranteed long-term solution.

TPS is still temporary. It does not automatically lead to a green card. It also does not cure most immigration challenges, nor does it always protect someone from removal or detention.

That is why this may be an important moment to ask:

Is TPS my only protection, or do I have another immigration path available?

If you have TPS from El Salvador, now is a good time to gather and review your immigration documents, including TPS approvals, work permits, notices from USCIS, passports, travel records, prior immigration applications, family petitions, court records, and any documents connected to your immigration history.

The goal is not to create fear. The goal is to understand the full picture.

For some people, TPS may still be the only protection available. For others, there may be another path worth exploring, such as a family-based petition, adjustment of status, consular processing, waiver, U or T Visa, or another form of relief.

At BLMT Immigration Law (Previously Bean, Lloyd, Mukherji, & Taylor, LLP), we help individuals and families understand their options, assess risk, and prepare carefully before making important immigration decisions.

02. Thinking About Applying for a Green Card? What to Review Before You File in 2026

Applying for a green card is an important step, but before filing, it’s worth looking beyond the forms.

Your immigration history, previous applications, criminal history, and other circumstances can all affect how USCIS evaluates an application.

Review your immigration history

Before applying for adjustment of status, it is important to understand your complete immigration history, including:

* How you entered the United States
* Whether you overstayed a visa
* Whether you worked without authorization
* Previous immigration applications or denials
* Prior immigration court or removal proceedings

An approved family petition does not automatically resolve every immigration issue.

Review previous applications carefully

If a previous immigration application contained an error, omission, or inaccurate statement, the goal should not be to simply repeat that information.

The priority should always be providing truthful and accurate information now and explaining any important differences when necessary.

Criminal history can also matter

Even an old, dismissed, or seemingly minor criminal matter may have immigration consequences.

Before filing, it can be important to understand exactly what happened, what the final outcome was, and whether additional documentation or review is needed.

Public charge changes are also coming

Changes related to public charge are scheduled to take effect "September 18, 2026".

These rules do not apply to everyone, but for some applicants they may affect how an adjustment-of-status application is evaluated.

This makes it especially important to understand your individual circumstances — and whether timing should be part of the conversation before filing.

Before you file
The question should not only be:

“Can I apply for a green card?”

It should also be:

“Is there anything in my history that I should understand or address before I file?”

Not every issue means someone is ineligible. But identifying potential concerns early can help applicants make more informed decisions.

01. Marriage-Based Green Cards: What Evidence Matters Most?

Applying for a marriage-based green card can feel deeply personal.

You may know your relationship is real. But in an immigration process, the question becomes:

Can your relationship be clearly shown through the documents, history, and details you provide?

A strong marriage-based green card application is not just about being married or submitting forms. It is about helping USCIS (U.S. Citizenship and Immigration Services) understand the full picture of your life together.

Why evidence matters

The government looks for evidence that the marriage is legally valid and entered into in good faith.

That does not mean every couple needs the same documents.

Some couples have joint leases, bank accounts, insurance policies, and years of shared records. Others live with family, keep separate finances, recently married, or spent part of their relationship long-distance.

The goal is not to create a “perfect” file. The goal is to create an honest, organized, and well-supported one.

Helpful evidence may include:

* Marriage certificate
* Proof prior marriages legally ended, if applicable
* Shared housing or address records
* Joint financial records
* Insurance or beneficiary documents
* Children’s birth certificates
* Photos from different stages of the relationship
* Travel records
* Communication history
* Affidavits from people who know the relationship
* Documents showing shared responsibilities or household life

Every relationship is different

Not every couple has a joint lease, joint bank account, or shared insurance.

That does not automatically make the application weak.

It means the application should be prepared around the couple’s real life — not someone else’s checklist.

Before filing, couples should review whether the marriage is legally valid, whether prior marriages legally ended, whether addresses and dates are accurate, and whether there are any immigration, travel, criminal, or tax issues that should be reviewed first.

Preparation matters.

The bottom line

A marriage-based green card application is never just paperwork.

It is a request that asks the government to understand and trust the reality of your marriage. That requires preparation, honesty, organization, and a clear presentation of your relationship.

At BLMT Immigration Law (Previously Bean, Lloyd, Mukherji, & Taylor, LLP), we help individuals and families review their options, prepare carefully, and understand the best path forward.

07/28/2026

Recently, a Federal District Court in Massachusetts told U.S. Citizenship and Immigration Services that they temporarily cannot impose certain policies connected to the H.R. 1 “One Big Beautiful Bill”. The main policies were 1) a policy that would cause certain TPS work permit holders to have their work permits expire on July 22, 2026, and 2) a policy that would let USCIS impose a range of harmful penalties for failure to pay the new “annual asylum fee”. These policies are only temporarily stopped while the court reviews their lawfulness and we expect a decision from the court by August 5, 2026.
