Many people affected by long COVID have lost their jobs and now rely on disability checks to try to survive. But getting approved for long-term federal disability for long COVID is a major challenge.

I recently attended my first zoom as a liaison to the ABA’s Commission on Women in the Profession. I’m grateful to the Labor and Employment Law Section for entrusting me as their Liaison. Advancing women’s rights has been one of my major drivers in life - ever since I was bullied for being an outspoken feminist in middle school. From then, to majoring in Women’s Studies and English at UC Berkeley back in the 90s, to owning a law firm comprised of all women (and all moms!), to raising 3 daughters and a feminist son, to now: both serving in this role and also co-chairing the LEL Women Attorneys’ Affinity Group - I feel so fulfilled and so ready to continue the work. Litigation against insurance companies for failing to pay disability benefits to people who can no longer work after having Covid-19 is on the way, attorneys say, the cases just take time to gain momentum.

Springer Ayeni is very excited to report that the Employee Benefits Security Administration (EBSA), issued a favorable information letter to our firm stating that all ERISA insurers that record conversations, even if just for "quality assurance," must now release those recordings and transcripts to claimants upon written request following an adverse benefit determination. https://www.dol.gov/agencies/ebsa/about-ebsa/our-activities/resource-center/information-letters/06-14-2021 This decision will help thousands of disability and health benefit claimants whose conversations were incorrectly documented in the claim file. Congratulations to Rachel Coen at Springer Ayeni for her work in obtaining this extremely helpful interpretation of the ERISA Regulations.
