A big shout-out to my good friend, true patriot, and fellow Super Lawyer, Chris Jafari, for generously sharing with me a draft of his successful motion to withdraw a guilty plea entered without the client being properly advised of the immigration consequences of the plea.

After nearly a year of litigation, we were able to successfully set aside the guilty plea, clearing the way for our client to pursue a change in her immigration status and remain in the United States with her family—including her daughter, who proudly serves in the United States Navy.

The new motion seems to have some overlapping arguments with the motion she filed in 2024. This is according to federal authorities, the actual motion has not been made public yet. Her arguments in 2024 were :

“Ghislaine, in March, asked the U.S. Court of Appeals for the Second Circuit to overturn her conviction and 20-year prison sentence for recruiting and grooming the underage girls who Epstein s*xually abused, arguing she was immunized by an agreement federal prosecutors in Florida arranged with Epstein in 2007.”

Villarreal v. Texas (Feb 2026), is a decision by the SCOTUS holding that a defendant's rights to consult with his or her lawyer during an evening recess while testifying in court can be limited, and such limitation is not a violation of the defendant's Sixth Amendment rights. The Supreme Court resolved a circuit split by establishing that banning attorney-client discussion during an overnight break, but only regarding the testimony itself, is not a violation of the Sixth Amendment. However, attorneys and clients must still be allowed to confer on broader issues, like strategy, plea negotiations, and witness availability.
