You also need to establish where and how the donor obtained the funds and show that the money was provided as a genuine gift rather than a loan or an arrangement with repayment terms.

A lot of people don't realize that you can travel while your green card application is pending, but only if you have advance parole. It's a travel document that gives you permission to leave the U.S. and come back without putting your case at risk. Without it, leaving the country could be treated as abandoning your application entirely, even if you've been waiting for months or years.

If your application is pending and travel is even a possibility, make sure you have secured an advance parole, so you can travel without worrying.

Can You Retire in the U.S. on an E-2, L-1, or H-1B?

No. Individuals on nonimmigrant work visas generally cannot retire and continue living in the U.S. under the same status. These work visas require the principal visa holder to continue qualifying employment or business activity. Once they stop working, they may no longer meet the requirements of their status.

If you are considering retiring in the U.S., it is important to plan for the immigration side of retirement years before your target date, not just the financial side. ⚖️

USCIS Can Now DENY Your Case WITHOUT an RFE

A recent USCIS policy change gives officers more discretion when adjudicating applications and petitions. One of the most significant changes is that officers can now deny cases without first issuing an RFE when required initial evidence is missing. If an RFE is issued, officers may also set a shorter response period, giving applicants less time to respond.

Can a criminal conviction impact your Green Card after you’ve already received it?

Having a green card does not shield you from the immigration consequences of a criminal conviction. If the crime is a deportable offense, the government can initiate removal proceedings regardless of how long you have had your permanent resident status.

Recent developments, including recent Supreme Court precedent, have made this landscape even riskier. Traveling internationally with pending criminal charges or past convictions can now lead Customs officers to parole you back into the country rather than formally admitting you, which can expose you to potential removal proceedings.

Can ESTA Travelers Be Deported Without Seeing an Immigration Judge?

Unlike travelers who enter the U.S. on a standard visa, ESTA travelers who overstay or violate the terms of their admission could face expedited removal without appearing before an immigration judge. By entering under the Visa Waiver Program, they generally waive the right to contest removal in court.

That becomes especially important when considering domestic air travel. With increased ICE arrests at U.S. airports, travelers who have overstayed or otherwise violated their immigration status may face additional enforcement risks when traveling within the country. Before boarding a domestic flight, it is important to understand how your immigration status could affect you.

Can You Get a TN Visa Without a Job Offer from a U.S. Employer?

The short answer is no. The TN visa is one of the strictest categories when it comes to employer sponsorship. A bona fide job offer from a U.S. employer is a strict legal requirement.

If you are thinking about self-employment through your own business or startup, the TN is simply not designed for that. While holding a minority interest in the sponsoring company is technically possible, officers heavily scrutinize these applications because of the strict employer-employee relationship requirement. ⚖️
