H-1B visa explained:
Requirements:
1. A valid job offer from a U.S. employer for a role that requires specialty knowledge
2. Proof of a bachelor’s degree or equivalent experience in that field
3. Your employer must show that there is a lack of qualified U.S. applicants for the role
Common questions:
1) I have a relative in USA who offered me a job. Can I apply for H-1B visa?
Answer - Not necessarily. In order for you to be eligible, the employer must get US DOL (Department of Labor) certification. This certification will prove that no skilled US worker was available for that job, that’s why your work is required.
So if the nature of job is unskilled in nature or doesn’t have any means to prove that it’s a skilled work where finding an eligible American citizen was difficult, then your visa will be denied.
