For those of you who missed a terrific and well attended DANY alumni event last week, Adam Kaufmann, Elyse Ruzow and I are incredibly excited to officially announce and launch OneHogan.Com, the alumni directory for former prosecutors and investigators with the Manhattan District Attorney’s Office.

Want to catch up with a fellow classmate from ‘92? You can search by rookie year. Full segment, albeit not a deep dive, discussing Renee Good’s homicide and the actions of ICE agent Jonathan Ross that lead to her death on NBC News’ Stay Tuned Now with Gadi Schwartz.

As I noted, and it seems to be the norm these days, two things can be true: Good needed to comply with the law and not obstruct law enforcement. That, however, doesnt mean she deserved to be shot or die. People need to stop placing themselves in the literal line of fire and instead pursue safe and lawful means to challenge ICE activities that don’t jeopardize themselves, agents, civilian or others’ safety.

At the same time, this was an unnecessary and fatal escalation by Ross based on what I believe to be an objective view of the “reasonable person” standard relevant here. It appears generous to assert Ross’ response of opening fire in a residential neighborhood with both civilians and fellow officers in the immediate area was an objectively reasonable response to what appears to not be an imminent risk of something as a serious physical injury or even death when we examine the car speed, wheel turning away, Ross’s ability to safely move away and dicharge his weapon from the side once he cleared the SUV, and even the lack of warning, concerns or other calls to “watch out” or similar from his fellow agents who ducked away from his shots. Further, objectively, it doesn’t help Ross that he exclaimed in anger not that he was almost or in fact hurt, but Good was a “f**king bitch”.

Lastly, and likely relevant here, according to reports, Ross was recently dragged by a vehicle 100 yards during a stop and injured. As much as we can and should empathize with that trauma, the legal standard is an objective reasonable person one, not that of a person who may be jumpy or quick to act because of a prior vehicular assault.

Though not addressed, Ross does NOT have absolute imminuty. It is a farce to assert as such.
