CAN YOU VACATE A CONVICTION THAT DOES NOT EXIST? The weird thing is you can. New york has vacated and sealed all ma*****na convictions that involve laws that have been repealed as a result of ma*****na legalization. BUT IMMIGRATION AUTHORITIES DO NOT HONOR THOSE DISMISSALS! Luckily, New York allows you to move to vacate those convictions in a way that works with immigration and I have been successful with those motions.
