🚨 MAY 2026 VISA BULLETIN UPDATE: IMPORTANT EMPLOYMENT-BASED FILING CHANGE
The Department of State has released the May 2026 Visa Bulletin, and there is an important procedural update for Employment-Based Green Card applicants.
🛑 Key Filing Update (Employment-Based ONLY):
Starting May 1, USCIS will require Employment-Based Adjustment of Status applicants to use the Final Action Dates chart for determining eligibility to file.
This means applicants can no longer rely on the more favorable Dates for Filing chart for Employment-Based cases in May.
💡 What this means in practice:
If you were eligible to file under the Dates for Filing chart in April but your priority date is not current under the Final Action Dates chart, you may no longer be eligible to file in May and will need to wait until your category becomes current again.
(This change does NOT affect Family-Based filings, which continue using the Dates for Filing chart.)

• EB-1: Current
• EB-2: Current
• EB-3: August 1, 2023
• EB-3 Other Workers: November 1, 2021
👨👩👧 Family-Based (Dates for Filing):
• F1: April 22, 2015
• F3: August 8, 2006
• F4: March 22, 2008
💡 Takeaway: Employment-Based applicants should carefully review the Final Action Dates chart before preparing to file in May. In some cases, eligibility that existed in April may no longer apply under the May filing rules.
