Visa Bulletin movement can change quickly from month to month, and in some situations, applicants who were eligible to file one month may find they are no longer eligible the next due to chart movement or retrogression.

Here’s what that actually means for you:
1️⃣ Your approved I-140 remains valid
Nothing about your underlying immigrant petition is “lost” because the priority date is still yours and remains locked in for future use.

2️⃣ You cannot file I-485 until your priority date is current under the chart USCIS is using that month
Each month, USCIS announces whether Employment-Based filings must use the Final Action Dates or Dates for Filing chart. If your category is not current under the applicable chart, you must wait.

3️⃣ Your strategy now is maintenance + timing
If you are in the U.S., maintaining lawful nonimmigrant status (such as H-1B, L-1, F-1 OPT, etc.) remains essential while you wait for your priority date to become current again.

Immigration timelines are constantly shifting — and temporary setbacks are common, especially in oversubscribed categories.

The latest Visa Bulletin shows positive movement in the F2A category (spouses and unmarried minor children of lawful permanent residents), giving many families renewed hope in the green card process. 👨‍👩‍👧
For this month, USCIS is allowing family-based applicants to use the “Dates for Filing” chart, which may open the door for some applicants to submit their Adjustment of Status (Form I-485) sooner, depending on their priority date.

What this means:
1️⃣ Some F2A applicants may now be eligible to file if their priority date is current under the applicable chart
2️⃣ Eligibility depends on USCIS chart selection and individual priority dates
3️⃣ Movement can change monthly, so timing matters

🚨 MAY 2026 VISA BULLETIN UPDATE: IMPORTANT EMPLOYMENT-BASED FILING CHANGE
The Department of State has released the May 2026 Visa Bulletin, and there is an important procedural update for Employment-Based Green Card applicants.

🛑 Key Filing Update (Employment-Based ONLY):
Starting May 1, USCIS will require Employment-Based Adjustment of Status applicants to use the Final Action Dates chart for determining eligibility to file.

This means applicants can no longer rely on the more favorable Dates for Filing chart for Employment-Based cases in May.

💡 What this means in practice:
If you were eligible to file under the Dates for Filing chart in April but your priority date is not current under the Final Action Dates chart, you may no longer be eligible to file in May and will need to wait until your category becomes current again.

(This change does NOT affect Family-Based filings, which continue using the Dates for Filing chart.)

🇵🇭 PHILIPPINES VISA BULLETIN HIGHLIGHTS (MAY 2026)
💼 Employment-Based (Final Action Dates):

• EB-2: Current

For the first time in a long time, the "Dates for Filing" chart for the F2A category (Spouses and Unmarried Minor Children of Permanent Residents) is listed as CURRENT (C) for all countries, including Mexico and the Philippines!

What this means: If USCIS allows us to use the Filing chart this month, you can submit your I-485 (Adjustment of Status) application immediately, regardless of when your petition was filed. This allows you to apply for your work permit and travel document while you wait for final approval.
