Medical malpractice allegations often begin with a deceptively simple question:
“Should this have happened?”
For the attorney evaluating the case, however, the answer may be buried across hundreds—or thousands—of pages of medical records.
A delayed diagnosis may require reconstructing when symptoms first appeared, what the provider knew at each point in time, which tests were ordered, what results were available, and whether an earlier intervention could have changed the outcome.
A surgical complication requires more than identifying the injury. The operative report, anesthesia record, nursing documentation, pre- and postoperative assessments, imaging, laboratory results, and subsequent treatment may all contribute pieces of the story.
Medication cases can become even more complex. Insulin, anticoagulants, opioids and other high-risk medications require careful attention to dosing, timing, laboratory values, monitoring, contraindications, allergies, medication reconciliation, and the patients clinical response.
And cases involving sepsis, anesthesia complications, neurologic injury, or unexpected deterioration often require one critical skill: Connecting what happened clinically with when it happened. THE TIMELINE IS CRITICAL FOR LINKING CAUSATION.
That is where a Legal Nurse Consultant can bring tremendous value to the litigation team.
At LawMed Nurse Consulting, I approach the medical record as an Objective Nurse Detective—looking beyond individual entries to identify patterns, inconsistencies, missing pieces, changes in condition, significant clinical findings, and the sequence of events that may matter to the case. LawMed can assist attorneys with:
• Medical record review and case screening for merit
• Detailed chronologies and timelines
• Identification of significant clinical events and changes in condition
• Standard-of-care and breach analysis within the appropriate nursing/clinical scope
• Causation-focused record analysis
• Medication and high-risk drug review
• Surgical, critical-care and nursing documentation analysis
• Identification of records or information that may warrant further investigation
• Clear written summaries that translate complex medicine into language useful to the legal team
With 35+ years of clinical nursing experience, including critical care/CVICU and the operating room, I know that some of the most important clues in a medical record are not necessarily found in one glaring or obvious note. Sometimes the story emerges only after the pieces are put together.
