On March 31, 2026, the U.S. Citizenship and Immigration Services (USCIS) has received enough electronic registrations for unique beneficiaries during the initial registration period to reach the fiscal year 2027 H-1B numerical allocations (known as the H-1B cap), including the advanced degree exemption (master’s cap). The USCIS has notified all prospective petitioners with selected beneficiaries that they are eligible to file an H-1B cap-subject petition for those beneficiaries. Registrants’ online accounts will display their registration status.

The cap for the first round of H-2B returning worker visas for FY 2026 has been already reached.

On February 13, 2026, U.S. Citizenship and Immigration Services (USCIS) confirmed that it received enough petitions to exhaust the 18,490 supplemental H-2B visas allocated for returning workers with start dates between January 1 and March 31, 2026.

February 6 was the final receipt date. Because filings exceeded available numbers, USCIS conducted a computer-generated random selection process for petitions submitted during the first five business days (February 2–6). Premium processing began after the lottery.

What does this mean for employers?

Demand continues to far outpace supply. For businesses in hospitality, landscaping, construction, seafood processing, and other seasonal industries, access to H-2B workers remains highly competitive — and timing is everything.

If your petition was not selected, it’s critical to assess next steps quickly and prepare strategically for upcoming allocations. Workforce planning can’t wait until the next filing window opens.

On January 30, the Department of Homeland Security and the Department of Labor issued a temporary final rule increasing the H-2B visa cap by up to 64,716 additional visas for fiscal year 2026. These supplemental visas are available to U.S. employers that attest they are experiencing, or will soon experience, irreparable harm if they cannot hire the requested H-2B workers.
The additional visas will be released in three allocations to accommodate different employment start dates. Of the total, 46,226 visas are reserved for returning workers, while 18,490 are designated for late-season needs for jobs beginning between May 1 and September 30, 2026, without a returning-worker requirement. This increase is authorized under time-limited statutory authority and will not apply to future fiscal years.

On February 25, 2025, President Trump announced a new immigration visa program for permanent residency which he referred to as “Trump Gold Card” for foreign nationals for $5 million. "It's going to be a route to citizenship, and wealthy people will be coming into our country by buying this card. They'll be wealthy, and they'll be successful, and they'll be spending a lot of money and paying a lot of taxes," Trump told reporters.

According to Commerce Secretary Howard Lutnick, the “Trump Gold Card” would effectively replace EB-5 immigrant investor visa for at least $1.05 million in a new business that creates jobs or $800,000 if the business is in an under-served (high unemployment) rural area. Trump said the program will be “rolled out in two weeks to very high-level people”.

DHS’s final rule on H-1B, H-2B and H-2A visas took effect on January 17, 2025 . USCIS published a revised form I-129 that went into effect on January 17, 2025 with no grace period, and both rules were published in the Federal Register on December 18, 2024.

The new rules and the form I-129 impose significant new requirements on employers which may result in important consequences. It’s highly advisable to carefully review the new rules and questions, in particular on pages 15-18 questions no. 1 through 23 of the revised form I-129. We have published a detailed newsletter in this regard, and can be sent to you upon request.
